Garage Sale Guidelines
Sec. 13-120. Applicability.
For the purpose of these rules and regulations, it is of no significance whether the sale is called a garage sale, porch sale, or by other name. Any sale or attempted sale of personal property which involves three (3) or more items of property for which any person does not obtain a business or occupational license, shall be subject to the following rules.
Sec. 13-121. Limitation on number of sales per year; interval between sales.
No more than three (3) sales of the nature described above may be conducted at any residence or any location during a twelve-month period. In the event that more than one (1) sale is conducted at any residence during the twelve-month period, it shall not occur within three (3) months of the date of the last proceeding sale conducted at that residence.
Sec. 13-122. Duration of sale.
No sale described in this division shall be conducted for a period in excess of seventy-two (72) consecutive hours.
Sec. 13-123. Sale in vacant house or place of business prohibited.
No sale shall be conducted in any vacant house or in any place of business.
Sec. 13-124. Adequate parking to be provided.
Any person or persons conducting a sale described in this division shall be responsible for providing adequate parking to avoid the creation of a hazardous traffic condition at or near the sale location.
Sec. 13-125. Penalty.
Any person who violates any rule or regulation set out in this division shall be liable for a fine not to exceed two hundred fifty dollars ($250.00). The violation of any rule set out in this division shall be considered a separate violation from other violations of the division.
